Welcome to Dr. Brown’s (“we” or “us”), a brand of the Handi-Craft Company. Thank you for your interest in interacting with Dr. Brown’s by visiting our website, communicating with us, buying our products, or otherwise using the services offered by Dr. Brown’s to our Visitors and Customers (collectively “users” or “you”). Please read the following Privacy Notice carefully before using any of Dr. Brown’s websites, mobile applications, electronically delivered products, social media venues, blogs, e-commerce stores and/or online accounts, customer service support (by phone and email), before purchasing products from us, or before otherwise interacting with us (collectively, our “Services”). You may access or interact with our Services through a number of different vehicles, such as through a computer, mobile phone, tablet or other devices, as well as in-person. This Privacy Notice governs your use of our Services regardless of how you interact with us. By using or accessing our Services, you consent to the terms of this Privacy Notice.

This Privacy Notice explains how we collect, use, and disclose information about you through our Services as well as any other third-party services or products that link to this Privacy Notice.

What’s covered by this Privacy Notice?

This Privacy Notice applies to and describes the information that Dr. Brown’s collects and uses when you interact with our Services, whether you interact with us as a customer, website visitor, participant in one of our programs, or otherwise. This Notice also discusses how Dr. Brown’s Medical collects and uses information, which is described in its own section below called “Dr. Brown’s Medical.” This Privacy Notice does not cover, and we are not responsible for, third-party websites or applications that may be linked from the Services we provide. We encourage you to read the Privacy Notice of every website and mobile application that you visit or use.

Throughout this Notice, we refer to the term “Personal Information.” Personal Information is information that identifies, relates to, or is reasonably capable of being associated with an individual person or household. This can be, for example, a name, street address, email address, or unique device identifier, among other things. Personal Information does not include information that has been aggregated or de-identified, or information that is publicly available and lawfully collected.

Information Collection

We collect information from individuals in various ways, including when you provide information to us directly, through automatic data collection technologies, and from third parties and publicly available sources. We may collect information about you through one or multiple of these ways. The below subsections describe the three ways that we may collect information from or about you.

Information You Provide to Us Directly

When you create an account, purchase a product, participate in a program, sweepstakes, or survey that we offer, sign up for email communications, contact us or communicate with us, or otherwise submit your personal information to us, we collect information from you directly. We may collect any of the following types of Personal Information (“Personal Information”) directly from you when you use or interact with our Services:

  • Name
  • Email address
  • Phone number
  • Mailing address
  • Age or date of birth
  • Gender
  • Number of children you have
  • Information about your pregnancy and delivery, such as your stage of pregnancy, your due date, or how far along into your pregnancy you gave birth
  • Approximate location information
  • Testimonial information
  • Information about products you have purchased from us, and your shopping habits
  • If you enter and win a sweepstakes we offer, we collect tax information and other information from you to comply with our obligations and to provide you with your sweepstakes winnings
  • Any other information you voluntarily submit to us
  • Any other information you consent to disclose at the time we collect it

In addition to the Personal Information listed above, we may also collect non-personal information (for example, breast pump warranty information) directly from you. We may combine this non-personal information with Personal Information we’ve collected from you to associate the non-personal information with you. When we combine the information so that it all relates to you, we will treat it as Personal Information.

Because our business primarily serves parents and children, we may also collect information from you about your child. We only collect this information when you voluntarily provide it to us, and thus, consent to the collection of information from or about your child. We may collect any of the following types of information about your child, when you choose to provide it to us:

  • Name
  • Height and weight
  • Age or date of birth
  • Gender
  • Information about your child’s birth, such as whether they were born premature
  • Information about your child’s eating habits, such as whether they have any difficulty feeding or eating, what stage of feeding they are at, and similar information

Information We Automatically Collect

We may automatically collect certain Personal Information or other technical data from your computer or mobile device when you use our Services. We receive information from your device, including but not limited to IP address, web browser, operating system, mobile operating system version (to the extent applicable), and unique device identifiers. We may also collect and store your browser settings and preferences.

Additionally, we may automatically collect information about your interactions with our Services and may combine this information with other information about you in order to customize your online experience with us. The information we automatically collect may include your IP address, referring URLs, browser and device characteristics, browsing behavior (e.g., date and time of visit, length of visit, clicks on product information or other content, etc.) and your response to our email campaigns (e.g., whether and when you open our email, the links you click, etc.).

We may use cookies, and other similar industry standard technologies to automatically capture this information. A “cookie” is a small amount of data that is sent to your browser from a web server and stored on your computer or device. Among other things, cookies allow us to improve the effectiveness and facilitate the administration of our Services, as well as further tailor and enhance your experience to your interests. You may set your browser to decline cookies. If you do so, you may not be able to experience certain interactive features of our Services fully. We may also use third-party analytics companies, such as Google Analytics, Adobe Analytics or Amazon Web Services (“AWS”), to analyze the usage of our Services for internal purposes. These analytics companies may use cookies and other tracking mechanisms to collect data about how you use our Services and provide us with aggregate information on such usage, which helps us improve the performance of our Services. Please review Google’s privacy policy, Adobe’s privacy policy, or AWS’ privacy policy to learn more about each company’s privacy practices.

We may also permit other third parties to gather information automatically on our Services for advertising purposes, as described below in the Interest-Based Advertising section.

Information We Collect from Third Parties and Publicly Available Sources

We may also collect information from third parties or information that is publicly available. This generally occurs when you direct the third party to share the information with us, such as when you link your social media account to our services, among other examples. For more information about this, please see the below section titled “Social Platform Registrations and Social Media Plugins.” We may also collect information from third parties or that is publicly available regarding your online or social media activity. For more information on our targeted advertising practices, please see the below “Interest-Based Advertising” subsection.

Combining Information

We may combine the information we collect from one source with the information we collect through a different source. For example, we may combine the information we collect directly from you with information we receive from third parties about you. We may also combine Personal Information we collect from or about you with non-personal information. Where Personal Information is combined with non-personal information so that it identifies or relates to you, we will treat the information as Personal Information.

Further, we may combine the information you provide about your child with the information we have collected about you, so that we can associate your child with your information. This means that we may associate your mailing address with your child, where you have provided information about your child, for example.

Aggregated or De-Identified Information

Some of the information we collect may be in aggregate or de-identified form, or we may take steps to aggregate or de-identify information we have collected from you so that the information does not personally identify you or your household. Aggregate and de-identified information is not Personal Information. We will not attempt to re-identify any de-identified or aggregated information.

Information Use

Dr. Brown’s uses the Personal Information we collect from and about you for the following purposes:

  • to complete your transaction, fulfill your order, or provide you with Services you request from us;
  • to respond to your inquiries, forward you information you request and provide customer service;
  • to send you relevant administration information regarding our Services;
  • to supply you with newsletters, promotional emails about us and our partners, product information, event-related news and surveys, and giveaways;
  • to communicate with you about our sweepstakes, contests and other promotions which you have entered or joined, or for which you have requested information, including for the purpose of notifying you if you win;
  • to identify your consumer review on our Services, if you provide your Personal Information for disclosure;
  • to conduct research and perform analysis in order to measure, maintain, protect, develop and improve our products and Services;
  • to comply with relevant legal requirements, including FDA regulations, among other legal requirements;
  • to detect, investigate and prevent activities that may violate the law or our policies;
  • to target relevant advertising to you when you visit our Services or other third-party websites;
  • to provide you with a personalized consumer experience on our Services;
  • to otherwise maintain and optimize the Services we provide to you;
  • for other purpose that you direct us to; and
  • for any other purpose that you consent to at the time we collect your information.

Interest-Based Advertising

We may allow third parties to use cookies and other online tracking tools to better understand your behavior and browsing activities. We utilize these third party cookies and tools so that we can provide you with interest-based advertising (also referred to as “targeted advertising” or “cross context behavioral advertising”) while utilizing our Services and display our ads to you when you visit other sites. These third parties may passively collect information with these tools so that content specific to your interests can be delivered to you online.

You can prevent your receipt of interest-based ads by deleting and declining cookies in your browser or via our cookie consent manager. If you disable all cookies except for necessary cookies, which cannot be disabled, certain features on our websites may not work. Please note that cookie-based opt-outs are not effective in mobile applications. However, on many mobile devices, application users may opt-out of certain mobile ads via their device settings. If you opt-out using one of the above methods, you may still receive advertising from us (or from other websites and companies) that is not customized based on your information.

Some browsers offer a “Do Not Track” feature that lets you tell websites that you do not want to have your online activities tracked. Our Services do not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

Surveys

While visiting certain features of our Services, you may be given the opportunity to provide feedback regarding various Dr. Brown’s products. You may be given opportunities to rate Dr. Brown’s products and to publicly ask and answer questions pertaining to Dr. Brown’s products. In order to fully participate in these portions of our Services, you may be asked to provide your full name and an email address, and to create an online username which will be publicly linked to your product ratings, questions, answers and other comments. You will be required to agree to our Terms and Conditions of Use which require you, among other things, to verify that you are over the age of 18. You may also be prompted to submit additional voluntary information that is not required to participate, such as specific age range, gender, the state or city that you live in, address, phone number, website, and the length of time which you have used Dr. Brown’s products. This information may be linked to your chosen username to associate it with you. Dr. Brown’s maintains this additional voluntary information, if provided, and later uses it to help us better understand and respond to the collective feedback we receive.

Ordering

If you place an order through our Services, we must obtain Personal Information from you relating to the order, including your name, billing and shipping addresses, order information, and your email address to confirm your order and shipping. We use a third-party service to facilitate transactions and process payments, so we do not collect any payment or financial information other than your billing or shipping address, and potentially the status of payment (such as, that you paid for a product on a certain date). Personal Information and payment information will be collected directly by our third-party payment processing service in order to process your payment. Their privacy policy, rather than or in addition to this Privacy Notice, may also apply to the information they collect from you. If you submit any Personal Information relating to other persons to us or to our service providers in connection with the use of our Services, you represent that you have the authority to do so and to permit us to use the Personal Information in accordance with this Privacy Notice.

Newsletter and Email Communications

If you choose to sign-up for our newsletter or email communications, you must submit certain basic information during the registration process so that we can fulfill this request. This information may include Personal Information, such as your email address, and a confirmation that you are over 18 years old. This information is used to send the newsletter or email communications electronically, and to ensure that we can provide you with appropriate customer service and respond to your inquiries.

Social Platform Registrations and Social Media Plugins

Some of our Services permit you to use a third-party social networking platform such as Facebook, Instagram, Pinterest, TikTok, Twitter, and YouTube to connect to or with our Services. This includes the use of social media plugins such as the Facebook “Like” button, Twitter “Tweet,” Pinterest “Pin,” buttons, and other plugins we may add from time to time. When you use these social networking platforms and plugins in connection with our Services, your Personal Information that is collected by or associated with these social media platforms may be shared with us. If you mention or reference us on social media, we may ask your permission to repost your Facebook, Instagram story, or Twitter quotes on our Services. If you agree, you grant us the right to use your posts on our Services for promotional purposes.

When you use social networking platforms and plugins, you share your Personal Information with them, In addition, these platforms may be able to collect information about you, including your activity on our Services, and they may notify your connections on the social networking platform about your use of our Services. Please note that when social media platforms collect information about you through linking our Services to theirs, or through plugins, their privacy policies and applicable terms of use apply. We encourage you to read any applicable privacy policies and terms of use before providing your information to third parties, even if that third party is linked to or accessible from our website.

Dr. Brown’s Medical

Dr. Brown’s and its parent company, Handi-Craft, have certain agreements with hospitals so that Dr. Brown’s products may be used in hospital settings, and in hospital studies and research groups. We have these partnerships in order to conduct research and studies about our products so that we develop them to be more effective. Dr. Brown’s does not receive protected health information (“PHI”) or Personal Information related to individual patients from these hospitals. Dr. Brown’s employees do not have access to any patient information collected and retained by the hospitals Dr. Brown’s partners with. All information that Dr. Brown’s receives under these agreements with hospitals related to patients is de-identified or aggregated so that it does not identify or relate to an individual consumer or household.

Our medical division also works directly with parents in order to conduct market research about the effectiveness of our products, when parents opt to participate in these optional programs. For example, if you agree to participate, we may collect information about the effectiveness of our bottles or feeding tools with your premature or NICU baby, or about your baby who has various feeding issues or difficulties. We may ask you to provide information about your due date, discharge date, feeding date, how many weeks prior to term your baby was born, and similar information to help us understand the effectiveness of our products in specific situations. Providing us with any of this information is entirely optional, and all participation in these programs is strictly optional and voluntary. When parents choose to share photos or videos of their child with us (for example, so we can see the progress their child has made while using our products), we will also collect this information. Again, all of this information collection is entirely voluntary.

We also provide support and education materials for parents so that they can learn effective techniques for caring for their baby. However, Dr. Brown’s and its parent company, Handi-Craft, do not provide medical advice. Parents and users of Dr. Brown’s Medical’s services must seek medical advice and opinions from their medical provider of choice.

Information collected and used by Dr. Brown’s Medical is segregated from information collected by other business units of Dr. Brown’s. Dr. Brown’s Medical does not share information with other business units of Dr. Brown’s, and does not share or disclose any information collected by Dr. Brown’s Medical for targeted advertising purposes.

The “Information Collection and Use” and “Information Sharing and Disclosure” sections of this policy do not apply to Dr. Brown’s Medical information, and Dr. Brown’s Medical has different collection, use, and disclosure practices from the rest of Dr. Brown’s due to the nature of the data collected by Dr. Brown’s Medical. The Dr. Brown’s Medical collection, use, sharing, and disclosure practices are outlined in this section. The remaining sections of this policy, including how Dr. Brown’s safeguards and retains your data, and rights you have regarding your data, still apply.

Information Sharing and Disclosure

We may share your Personal Information with the following types of third parties:

Our Brands, Affiliates and Subsidiaries. We may share your Personal Information with the brands, affiliates, and subsidiaries of Handi-Craft Company.

Service Providers. We utilize third parties to perform services on our behalf, which may require us to share your Personal Information with them to perform the services. These third party service providers are obligated to keep your information confidential and only use it as necessary to perform services for us. For example, we may share your information with our agencies to help us administer a sweepstakes or other promotion; deliver content, samples, products, gifts, and prizes; or provide you with customer service. When you make a purchase through our Services, we may share your information for order fulfillment and payment processing.

Network Advertisers. We disclose Personal Information to third parties for network advertising purposes. Some of this disclosure is made via cookies, pixels, or similar technologies, as discussed in our Cookie Policy. To opt-out of information use and disclosure for interest-based or targeted advertising purposes, please use the mechanism described in the “Interest-Based Advertising” section. Legal Compliance Recipients. We may also share your information when we believe it is necessary to comply with the law or a government request; to prevent damage or injury to users or others, or to protect our rights. For example, we reserve the right to and may disclose your information in response to requests from local, state, or federal law enforcement officials; any judicial, administrative or similar proceeding or order, such as a subpoena; to investigate suspected fraud, harassment, physical threats or violations of our Service policies or the rights of third parties; or to investigate any suspected misconduct.

Successors. We may also share your Personal Information in connection with a merger, acquisition, sale or reorganization or the potential thereof, including with our successors in business and purchasers of Service assets, or with our affiliate companies for corporate reporting.

Public Forum. If you choose to share information about yourself in a public forum, such as through a social media platform like Facebook or Twitter, or in any user-generated content with our Services (e.g., a public comment or review, or a testimonial that you consent to our posting of), we consider that information to be public and not private. Others with access may read, collect and use that information. When you publish information, including any Personal Information, in public forums, you assume the risk that your information may be read, collected and shared by such other parties.

Safeguarding Your Personal Information

We have undertaken commercially reasonable efforts to prevent unauthorized access to the Personal Information we retain. However, due to the inherent open nature of the Internet, we cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. By using our Services, you accept all risks associated with any data transmission, including the risk that your Personal Information may be intercepted in transit.

We implement a variety of security measures to ensure the security of your Personal Information on our systems, including encryption and secure socket layer (SSL) technology, as well as physical, administrative, and organizational controls that are designed to help secure your Personal Information.

Information Retention

We retain information only for as long as reasonably necessary to fulfill the purposes set forth in this policy and consistent with our data retention policies, or for as long as required by applicable data retention laws.

Children’s Privacy

Although certain pages within the website may reference “children,” “babies,” or “infants,” Dr. Brown’s strictly intends our website to be used only by adults or children age 16 or older. Dr. Brown’s adheres to the Children’s Online Privacy Protection Act (“COPPA”) and other applicable state privacy laws with provisions that relate to child data, and does not knowingly register or otherwise collect Personal Information from any child under the age of 16 without the prior verifiable consent of the child’s parent or guardian. Under the Children’s Online Privacy Protection Act, parents have the right to review and have their child’s Personal Information deleted from our records. Parents also have the right to tell us to stop collecting or using their child’s personal information, where we have done so. To exercise these options, parents may email, call, or write to us via the information listed in the Contact Us section below. Please reference “COPPA Information Request” when making a request. If you believe we have collected information from a child without verifiable parental consent, please contact us using the information listed in the section below and reference “COPPA Information Request” so that we may take appropriate action.

Rights and Choices Regarding your Personal Information

Dr. Brown’s knows that privacy is important to you, so we strive to provide you with certain rights and choices regarding your Personal Information.

Update, Modify or Correct Your Personal Information

Dr. Brown’s takes reasonable steps to ensure that your Personal Information is accurate and up-to-date for the purposes for which it was collected. We encourage you to contact us to update or correct your information if it changes or if you believe that any information that we have collected about you is inaccurate. Consistent with legal requirements and limitations, Dr. Brown’s also permits you to obtain a copy of Personal Information that we hold about you. To do so, please email, call or write us via the information listed in the Contact Us section below.

Right to Unsubscribe

You have the right to unsubscribe from any Services that we offer if you no longer want to participate. To do so, please email, call or write us via the information listed in the Contact Us section below. If you wish to unsubscribe from marketing emails, you may do so by using the Unsubscribe button/hyperlink in the email communication. Please note that if you already have requested products or services when you decide to withdraw consent, there may be a short period of time for us to update your preferences to ensure that we honor your request.

Links to Other Websites

Our Services may contain links to other sites, including to those of our affiliates or third-party entities, which may have different privacy notices/policies and practices. These sites may also refer you back to our Services. We recommend that you read the privacy notices/policies of each site you visit to understand the site’s privacy practices. We are not responsible for the privacy practices of third-parties.

Changes to This Privacy Notice

As we continue to provide additional services and as privacy laws and regulations evolve, we may update this Privacy Notice. We may also update this Privacy Notice from time to time if our privacy practices change. We will update the “Last Updated” date at the top of this Notice so that you are aware of when this Notice last changed. We may also endeavor to provide you with direct notice, such as via email at the last email address we have on file or via a website popup or banner, if we make material changes to this Notice or to our privacy practices. We encourage you to review this Notice from time to time as you return to utilize our Services so that you are familiar with any changes. Changes are effective upon posting, unless otherwise indicated, and continued use or access of our Services will be subject to the updated policy.

Retention

We retain the above categories of information we collect for as long as reasonably necessary to fulfill the purposes set forth in this policy. Generally, we retain information for seven years, but we retain information longer where we have a legal obligation to do so.

Your California or Virginia Privacy Rights

If you are a California Consumer or Resident or Virginia Consumer or Resident (as defined in applicable laws), you have certain rights regarding your Personal Information, as listed below.

California Consumer Privacy Act Rights

California Civil Code Section 1798.100, et seq. (the “CCPA”) affords California Consumers the following rights regarding the Personal Information we maintain about them:

  • Right to delete (subject to certain exceptions)

  • Right to know which categories of your Personal Information are being collected and/or sold
  • Right to access Personal Information we have collected about you
  • Right to opt-out of sales or sharing of your Personal Information
  • Right to have someone you authorize make a request on your behalf

If you wish to opt-out of the sale or sharing of your Personal Information, you may do so by filling out the form on our website available at the “Do Not Sell or Share my Personal Information” link. Only you, or someone you authorize, may make a request. We will verify your request to ensure that you are the individual making the request, or to ensure that the individual making the request has your legal authorization. You may also exercise any of the above rights on behalf of your child, if they are age 16 or younger. We can more quickly respond and verify your request when you identify the type of request you are making when you contact us.

Virginia Consumer Data Protection Act Rights

The Code of Virginia § 59.1 Chapter 53 affords Virginia Consumers the following rights regarding their “personal data” (which we intend to include all information referenced as “Personal Information” in this Notice):

  • To confirm whether or not a controller is processing the consumer’s personal data and to access such personal data
  • To correct inaccuracies in the consumer’s personal data, taking into account the nature of the personal data and the purposes of the processing of the consumer’s personal data
  • To delete personal data provided by or obtained about the consumer
  • To obtain a copy of the consumer’s personal data that the consumer previously provided to the controller in a portable and, to the extent technically feasible, readily usable format that allows the consumer to transmit the data to another controller without hindrance, where the processing is carried out by automated means (the “Right to Portability”)
  • To opt out of the processing of the personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer.

The laws in the United States regarding the collection, use, and disclosure of personal information may differ from the laws in your jurisdiction, if you reside outside of the United States, and in some cases, may be less stringent than the laws in the jurisdiction where you reside.
